Terms and Conditions of Sale.
Terms and Conditions of Sale
1. Seller and Application
These Terms and Conditions of Sale apply when you order or buy products from OPPO Store South Africa through [OPPO Store URL], any OPPO Store app made available for South Africa, or another OPPO Store online channel clearly linked to these terms.
The seller is Boang Technology Proprietary Limited t/a OPPO SA, registration number 2020/162436/07, with its principal place of business at 1F, Building 9, Woodmead Estate Office Park, Woodmead, South Africa, unless a different seller is clearly identified before you place your order.
These terms apply to consumer purchases for personal use and not for resale or commercial distribution. We may refuse, limit or cancel an order where we reasonably suspect fraud, unauthorised resale, bulk buying, misuse of promotions, incorrect information or other unlawful or abusive activity.
2. Contract Documents
These terms should be read with the Terms of Use, Privacy Notice, Cookie Policy, Payment Policy, Delivery Policy, Return and Refund Policy, applicable OPPO warranty terms, product-page terms and promotion-specific rules. If a more specific rule applies to a particular product, promotion or operational issue, that specific rule applies to that issue.
You may save, print or download the terms that apply to your transaction. We will make transaction records available to you electronically where required by law and where technically available through the order flow.
3. Product Information and Availability
We take reasonable steps to display clear product information, including the product model, main features, price, compulsory charges, delivery information, warranty information and material restrictions. Product images are for guidance and may differ from the actual product.
Products are subject to availability. Listing a product on the Platform does not guarantee that it will remain available. If we cannot supply a product you ordered, we will notify you and refund any amount already paid within the period required by law.
Online products, variants, bundles, promotions, prices and availability may differ from those offered through offline stores, marketplaces or other sales channels.
4. Prices, Taxes and Errors
Prices are displayed in South African Rand (ZAR). Unless the page clearly states otherwise in a legally permitted way, prices for taxable supplies are inclusive of VAT at the prevailing statutory rate. Delivery fees and other compulsory charges will be shown before you place your order.
Prices may change at any time, but changes will not affect an order that we have already accepted.
If a displayed price or product description contains an obvious and material error that a reasonable customer should have recognised, we may contact you for confirmation at the correct price or cancel the affected order before dispatch and refund any amount already paid. Where the same product is displayed with two different prices, the lower price applies unless the lower price is an obvious error.
5. Order Process and Acceptance
Before placing an order, you will have an opportunity to review the products, price, delivery charges, payment method and delivery details, correct mistakes and withdraw from the transaction.
When you place an order, you make an offer to buy the products in your cart. We may send an order acknowledgement confirming that we received your order. This acknowledgement is not acceptance of your order.
A binding sale contract is formed only when we accept your order, usually by issuing a digital invoice, sending a shipping or dispatch confirmation, or otherwise confirming acceptance through the order flow.
We may cancel or refuse an order before acceptance where the product is unavailable, the order information cannot be verified, payment fails, a pricing or listing error occurred, fulfilment is restricted by law or regulation, or the order appears fraudulent, abusive or intended for unauthorised resale.
6. Payment
Orders must be paid in full using the payment methods displayed at checkout before we process and dispatch the order, unless the checkout page clearly states otherwise.
Available payment methods may include credit or debit card, instant EFT, bank transfer, wallet, payment-gateway checkout or other methods displayed at checkout. Payment processing is handled by PayU (PayU Payment Solutions (Pty) Ltd) or another payment partner clearly displayed at checkout.
OPPO SA is not accredit provider, if instalment, credit or buy-now-pay-later options are offered, they are provided by the relevant registered credit provider or payment partner under their own terms, unless we clearly state otherwise.
7. Delivery, Title and Risk
Delivery is governed by the Delivery Policy. Unless we agree otherwise, delivery is available only to eligible physical addresses in South Africa and not to P.O. boxes or addresses outside South Africa. We will deliver at the agreed place and, where a specific date or time was agreed, at that time. If we tender delivery at a materially different time, you may accept it or require delivery at the agreed time, subject to the CPA
Estimated delivery times are shown at checkout, in your order confirmation or through the tracking channel where available. Unless we agree a different delivery period with you, we will execute the order within 30 days after receiving it. If we do not do so, you may cancel the agreement on 7 days' written notice.
If we cannot perform because the goods are unavailable, we will notify you as soon as reasonably possible and refund any payment within 30 days after that notice, unless you choose and we agree to a later delivery date.
Subject to full payment, ownership of the products passes to you on delivery. Risk of loss or damage remains with OPPO Store until you, or a person authorised by you, accepts delivery at the delivery address.
8. Cancellations, Returns and Refunds
You may request cancellation before an order has been dispatched or moved to a stage where cancellation is no longer technically possible. If the order can be cancelled, we will process a refund to the original payment method where reasonably possible.
For an electronic transaction, you may cancel without reason and without penalty within 7 days after receiving the goods, subject to the exclusions under the Electronic Communications and Transactions Act. The only charge that may be levied is the direct cost of returning the goods, unless we provide a free return label or absorb that cost.
OPPO Store also offers a voluntary 14-day return for unopened, unused and resellable products with all accessories, manuals, packaging and free items, unless specific promotional terms say otherwise.
If your purchase results from direct marketing, a separate cooling-off right may apply. Where applicable, you may cancel the transaction within 5 business days.
Return steps, product-condition requirements, inspection and refund timing are set out in the Return and Refund Policy.
9. Faulty Products and Warranty
If goods fail to meet the standards required by the Consumer Protection Act within 6 months after delivery, you may return them at our risk and expense and choose repair, replacement or refund. If goods repaired under this statutory right fail again within the statutory repair period, you may be entitled to a replacement or refund.
OPPO commercial warranty terms published at https://support.oppo.com/za/warranty-policy/ or supplied with the product apply in addition to, and do not replace, statutory consumer remedies.
Warranty and defective-product remedies do not cover defects caused by normal wear and tear, accidental damage, misuse, negligence, tampering, unauthorised repair, alteration, improper care or use contrary to product instructions.
10. Software and Updates
Products may include software or firmware. Software is licensed for use with the product and is not sold separately. You must not reverse engineer, modify, copy, sublicense or distribute software except where applicable law allows it. Software or firmware updates may be required for security, compatibility or performance.
11. Liability
Nothing in these terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited. Subject to that, OPPO Store is not liable for indirect, consequential, exemplary or punitive loss arising from a purchase or use of products.
To the extent permitted by law, our liability for a product or service is limited to the actual direct damages you have incurred, up to the amount you paid for the relevant product or service.
