Terms and Conditions – #ShotonOPPO

#ShotonOPPO is an OPPO photography IP that is constantly operated by OPPO’s social media team. It is a platform for all OPPO users to share great photos taken by OPPO devices. #ShotonOPPO has monthly photo contests with different themes which are open to all users.
To participate in ShotonOPPO events (the “Contest”), follow the instructions and accept the following terms and conditions, which will form a binding agreement between you (the “Participant”) and Guangdong OPPO Mobile Telecommunications Corp, Ltd. (the “Promoter” or “OPPO”)

1.1. By participating in the Contest, you hereby accept these participation rules (referred to hereafter as "the Rules"). If you do not wish to accept these Rules, please do not enter.

1.2. The Participant must be a registered member of Twitter or Instagram, and should be a follower of the Promoter’s (Instagram @OPPO or Twitter @ OPPO) account. The account must be made public so the submission is visible to the Promoter.

1.3. In order to join the campaign, the Participant must share photos on Instagram or Twitter with #ShotonOPPO and the monthly campaign hashtag.

1.4. To qualify for participation in the Contest, you must be over 18 years of age. If under 18 years of age, you must first obtain permission from a parent or legal guardian.

1.5. The starting time of the monthly contests may differ. Please pay attention to the announcement post in OPPO accounts.

1.6. The Contest details form part of the Rules.

2.1. Each monthly Contest will have a unique hashtag. Sharing photos on Instagram/Twitter with the monthly hashtag will enable Participants to join the Contest. If you are an OPPO user, please add the hashtag #ShotonOPPO as well. For non-OPPO users, we have a public category for entries that are not shot on OPPO devices. Hence the need to only use the Contest hashtag, and not #ShotonOPPO.
Note: All photos MUST be taken by smartphones.

2.2. Each Participant can win a maximum of one prize for the giveaway.

2.3. Entry to this Contest is free of charge and is open to all countries. You understand and agree that not all the giveaways can be delivered successfully due to the requirement of applicable laws or logistical problems in certain countries or regions. In such an event, OPPO shall have the right to suspend such giveaways without any legal liabilities.

2.4. The Promoter is not responsible for entries to the Contest that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, or incomplete, for any reason whatsoever, will not be eligible.

2.5. By entering, Participants warrant and represent the following:(a) each Participant is the sole and exclusive owner of the submitted photos; (b) Participants’ submitted photos will not infringe on any proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (c) any third parties appearing in the submitted photos have given Participants appropriate consent to be photographed and used as permitted herein; (d) Submitted photos shall not violate any applicable laws.

3.1. OPPO will shortlist 2 to 4 candidates from all Participants (OPPO users and public entries), and post them on Instagram and Twitter for a public vote. The candidate with the highest vote total will become the final winner as long as they can provide authentic EXIF information of the photo. If not, the next-placed candidate will be selected, with the same verification processes, until there is a legitimate winner. The final results will be announced on OPPO social media channels.

3.2. The prize will vary month by month. Please pay attention to OPPO accounts’ monthly announcements.

3.3. Please pay attention to OPPO’s Instagram Stories and Twitter. The official OPPO account will contact you directly through Instagram’s or Twitter messaging system. Please check your messages frequently to avoid missing out! If you cannot reply within 72 hours, we will consider this as a waiver.

3.4. In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information, submission of incomplete or inaccurate contact information that prevents the Promoter from establishing contact) the prize will automatically be considered waived. The Promoter assumes no responsibility for any such outcome and will not reissue the prize in such cases. Upon receiving their prizes, winners will be expected to confirm completion of delivery by notifying the distributor directly, except where abnormal circumstances prevent this.

3.5. Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, the Promoter reserves the right to issue an equivalent prize in its place. Replacement awards may not be exchanged for cash.

3.6. Prize recipients shall bear full responsibility for any personal income taxes incurred with their prizes. The Promoter shall bear full responsibility for any domestic or international shipping charges incurred by the delivery of the prize.

3.7. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

3.8. Participants’ submitted photos must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, sexual, profane, tortuous, slanderous, discriminatory, or promotes hatred or harm against any group or person, contain any illegal information of a political, pornographic, or violent nature or which may be deemed to support terrorism, include any disparaging remarks relating to OPPO or a third party, or is disruptive to public social order and morality or otherwise does not comply with the theme and spirit of this Contest, as the Promoter may deem in its sole discretion.

3.9. Participants agree to indemnify Promoter and its officers, directors, employees, agents, distributors and affiliates from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorneys’ fees, resulting from your breach of article 2.5 and 3.8 of the Rules.

3.10. Providing a submitted photo constitutes the Participant’s consent to give the Promoter a royalty-free, irrevocable, non-exclusive license to use, reproduce, publish and display such photos in whole or in part, on a worldwide basis, in any form, media for one year for purposes of implementing the Activity.

4.1. Each Participant can submit more than one photo, but one photo per post, with the required hashtags.

4.2. Using #ShotonOPPO hashtag will not impact the winner selection process. However, please appreciate the fact that it is our way of differentiating entries between OPPO and public users.

4.3. Some OPPO products are not launched in specific countries. If the products are not available in your country, we will deliver the prize to you that we promised in the beginning of the campaigns. However, OPPO stores in your country will not be able to provide after-sales service for the products which are not launched in your country.

5.1. Personal information collected from each winner will be used by the Promoter for the purpose of delivering their prize. After the delivery is completed, the Promoter will delete all the personal information. The Promoter will not sell, share or otherwise disclose personal information of winners with third parties, other than to third parties engaged by the Promoter to fulfill the above purposes.
