  • OPPO Wins Patent Infringement Case against Fractus

December 07, 2020, SHENZHEN, CHINA – OPPO, a leading global smart device brand, today announced that it has received a favorable ruling from Shanghai Intellectual Property Court in the patent infringement lawsuit against Fractus.

The lawsuit was initiated by Fractus in China in July 2018, claiming that OPPO infringed its patents on antenna technology for wireless devices. In response to the case, OPPO filed an invalidation request against four of Fractus’ antenna patents to the CNIPA (China National Intellectual Property Administration). In September 2020, CNIPA affirmed OPPO’s requests and invalidated all the asserted patents. Following the success in patent invalidity, on November 10, 2020, the Shanghai Intellectual Property Court has ruled in favor of OPPO and dismissed all the claims filed by Fractus .

“The ruling follows the global trend of rejecting aggressive patent owners’ attempt to use legal actions to achieve their business objectives,” said Adler Feng, Senior Director of Intellectual Property at OPPO. “We are pleased with the outcome that supports OPPO’s position, and we will continue to focus on bringing innovative products and technology to our worldwide partners and users.”

OPPO always respects the intellectual property rights of others, while placing a high priority on its patent accumulation. As of September 30, 2020, OPPO has filed over 52,000 patent applications and has more than 21,000 granted patents globally. OPPO ranked the 5th in World Intellectual Property Organization’s 2019 PCT ranking and was the top 3 companies with the most filed utility patents related to wireless technology according to the latest research issued by IncoPat Innovation Index Research Center.
