Terms and Conditions – #OPPOLifesetter Activity

“#OPPOLifesetter Activity” (the “Promotion”) is organized and promoted by OPPO and is subject to the following terms and conditions.
To participate in the Promotion, follow the instructions and accept the following terms and conditions, which will form a binding agreement between you (the “Participant”) and Guangdong OPPO Mobile Telecommunications Corp, Ltd. (the “Promoter” or “OPPO”)

1.1. By participating in the Promotion, you hereby accept these participation rules (referred to hereafter as "the Rules"). If you do not wish to accept these Rules, please do not enter.

1.2. The Participant must be a registered member of Twitter or Instagram or Facebook ,or TikTok and should be a follower of the Promoter’s (@OPPO or OPPOGlobal) account. The account must be made public so the submission is visible to the Promoter.

1.3. The Participant must join the activity by submitting at least one photo or one video connected to the theme “OPPO Lifesetter” in the form of an Instagram or Twitter or Facebook post. The post caption must contain #OPPOLifesetter as a clickable hashtag.

1.4. By entering, each Participant warrants and represents the following:(a) Participant is the sole and exclusive owner of the submission; (b) the submission will not infringe on any rights of any third parties; (c) any third parties appearing in the submission have given entrant appropriate consent to be photographed and used as permitted herein.

1.5. Providing a submission constitutes the Participant’s consent to give the Promoter a royalty-free, irrevocable, non-exclusive license to use, reproduce, publish and display such submissions in whole or in part, on a worldwide basis, in any form, media for one year for purposes of implementing the Activity.

1.6. The entry starts at 12:00 am (UTC+08) August 1th, 2022 and will end at 23:59 pm (UTC+08) August 21st, 2022.

1.7. Totally 12 Participants will be awarded with the prize. Each Participant can only win a maximum of one prize. Foresaid prize winners are selected by OPPO based on the quality of work and performance, includes but not only number of like, comment, share /retweet.

1.8. Entry to this promotion is free of charge and is open to all countries. You understand and agree that not all the prizes can be delivered successfully due to the requirement of applicable laws or logistics problems in your country or region. In such an event, OPPO shall have the right to suspend such giveaway without any legal liabilities.

1.9. To qualify for participation in the promotion, you must be over 18 years of age. If under 18 years of age, you must first obtain permission from a parent or legal guardian.

1.10. The Promoter is not responsible for entries to the promotion that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, incomplete, for any reason whatsoever, will not be eligible.

1.11. The Promotion details form part of these terms and conditions.

2.1. At least three product bundle sets will be offered for this promotion. Each winner will have a customized product bundle set for a free product trial and a few items from the product bundle set will be awarded for this promotion. Prize details may vary based on products available in the regional market. .

2.2. In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information within 48 hours of the conclusion of the Promotion or submission of incomplete or inaccurate contact information that prevents the Promoter from establishing contact) the prize will automatically be considered waived. The Promoter assumes no responsibility for any such outcome and will not reissue the prize in such cases. Upon receiving their prizes, winners will be expected to confirm completion of delivery by notifying the distributor directly, except where abnormal circumstances prevent this. OPPO shall not be liable for any accidents or damages suffered by winners relating to the use or receipt of prizes.

2.3. Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, the Promoter reserves the right to issue an equivalent prize in its place. Replacement awards may not be exchanged for cash.

2.4. Prize recipients shall bear full responsibility for any personal income taxes incurred with their prizes. The Promoter shall bear full responsibility for any domestic or international shipping charges incurred by the delivery of the prize.

2.5. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

2.6. Prize recipients must strictly follow the OPPO Lifesetter Guideline and take responsibility for the Promotion. Prize recipients who fail to carry out responsibility for any reason whatsoever will result in disqualification. The Promoter reserves the right to offer the prize to another winner selected by the Promoter and ask prize recipients who fail to complete tasks or provide high-quality work to return all items from the product bundle set in good condition.

2.7. By entering, Participants warrant and represent the following:(a) each Participant is the sole and exclusive owner of the submission; (b) Participants’ submissions will not infringe on any rights of any proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (c) any third parties appearing in the submissions have given Participants appropriate consent to be photographed and used as permitted herein; (d) Submissions shall not violate any applicable laws.

2.8. Participants' submissions must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, sexual, profane, tortuous, slanderous, discriminatory, or promotes hatred or harm against any group or person, contain any illegal information of a political, pornographic, or violent nature or which may be deemed to support terrorism, or include any disparaging remarks relating to the ONEPLUS or a third party, or is disruptive to public social order and morality or otherwise does not comply with the theme and spirit of this Promotion, as the Promoter may deem in its sole discretion.

2.9. Participants agree to indemnify Promoter and its officers, directors, employees, agents, distributors and affiliates from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorneys’ fees, resulting from your breach of article 2.8 and 2.9 of the Rules.

3.1. The entry is open from 12:00 am (UTC+08 ) August 1th, 2022 and the Participant should response to the activity rule before 23:59 pm (UTC+08 ) August 21st, 2022.

3.2. The winners of the Promotion will be received a notification email from the Promoter by August 22nd, 2022.

3.3. Winners must then provide their URL into the post, full legal name, nominated prize delivery address, and contact phone number during the time period of the Promotion. If the selected winner fails to do so or is unable to comply with these terms and conditions, the Promoter reserves the right to offer the prize to another winner selected by the Promoter.

3.4. Use of a false name or contact information will result in disqualification.

3.5. If the winner(s) fails to redeem his/her prize, this will be deemed as a waiver of prizes. The Promoter will not be held responsible for rescheduling, replacement, or other liabilities.

4.1. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram, Twitter, Facebook or TikTok. Participants understand that they are providing their information to the Promoter and not to Instagram, Twitter, Facebook or TikTok. The information a Participant provides will only be used for the purposes outlined in this Rules. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Instagram, Twitter, Facebook or TikTok.

4.2. Promoter is not responsible for entries to the Promotion that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, incomplete, for any reason whatsoever, will not be eligible.

4.3. Participants understand and agree that not all the prizes can be delivered successfully due to the requirement of applicable laws or logistics problems in your country or region. In such an event, Promoter shall have the right to suspend such giveaway without any legal liabilities.

5.1. The Promoter reserves the right to make reasonable adjustments to the above Rules in keeping with standard practices for similar events and transfer of public gallery rights. Please refer to these terms regularly to ensure you are aware of and understand any changes made by the Promoter. By continuing to use this site, you accept these terms and conditions as legally binding regardless of any changes occurring herein.

6.1. Personal information collected from each winner will be used by the Promoter for the purpose of delivering their prize. And after the delivery is completed, the Promoter will delete all the personal information. The Promoter will not sell, share or otherwise disclose personal information of winners with third parties, other than to third parties engaged by the Promoter to fulfill the above purposes.
