OPPO Protection Plan

One Time Screen Protection ("Plan”)

I. Provided by:

OPPO Mobiles India Private Limited (“Company/OPPO”).

II. Benefits of Plan:

This Plan covers One Time Screen Protection only if the screen of the OPPO Mobile Phone (“Product”) is accidentally damaged such as liquid leakage in touch screen and crack on the touch screen will be considered for the replacement, except for the exclusions as mentioned hereunder.

III. Plan Term

Benefit(s) under the Plan begins when customer purchases the Product and the same is activated in accordance with the undermentioned scenarios and will end on completion of one (01) year from the date of purchase of the Product (“Plan Term”).

IV. Eligibility Criteria

This plan can only be purchased along with the purchase of Product from OPPO’s official e-commerce portal (i.e., https://www.oppo.com/in/store).
This Plan of One Time Screen Protection can be availed only if the screen of the phone is accidentally damaged such as liquid leakage in touch screen and crack on the touch screen will be considered for the replacement, except for the exclusions as mentioned hereunder.
In case of Online purchase (OPPO’s e-commerce platform) of the Product: Plan shall be purchased by the Customer along with the Product and will be activated from the date of purchase of the Plan.
Any bulk sale to corporate(s), firm(s) or any other institute or individual shall not be eligible for this Plan.
The customer cannot be benefitted with a same Plan twice.

V. Redemption of One Time Screen Protection Plan

There is a Processing Fee that shall be charged during a repair event under One Time Screen Protection plan as mentioned below:
I. Product cost below 20000 INR; 599 INR at the time of repair.
II. Product cost between 20001 to 30000 INR; 990 INR at the time of repair.
III. Product cost between 30001 to 40000 INR; 1499 INR at the time of repair.
IV. Product cost between 40001 to 50000 INR; 1999 INR at the time of repair.

Before availing the Plan, customer will be required to handover a copy of the invoice to the authorized service center, issued by the respective OPPO’s ecommerce platform Online at the time of purchase of the Product and produce the original invoice along with the same for verification.
In the event of any damage excluding the exceptions mentioned herein below, the Customer is required to submit (Not later than 48 hours from the time of damage) the Product to OPPO Authorized service center and make sure that digital Repair/ Receiving sheet is generated failing which no claims shall be entertained by the Company.
All original items replaced in the performance of services shall become the property of OPPO and the new or replacement parts will become the property of the Customer.
This Plan can be availed one time ONLY by visiting the authorized service center of OPPO.


Exclusions

The Plan will not cover:


If the Plan has been purchased beyond the eligible purchase window as defined in eligibility criteria.
Any damages to the Registered Product prior to the Plan activation.
Any loss under mysterious circumstances including lost or stolen.
Loss due to Intentional act or wilful neglect.
Loss arising before/after Coverage Period.
Any loss due to hire or loan of the Covered Product to a third party or if ownership is transferred.
Any damages occurred to the Covered Product prior to the activation.
Loss arising due to unlawful act including Terrorist activity, War, Nuclear Explosion, Radioactive Contamination, Chemical, Biochemical, Biological, Electromagnetic, Cyber Attack.
Consequential loss of any kind or description including wear & tear, manufacturing defects.
Customer’s Product is Beyond Economic Repair -: It means that your Product is not economical to repair. Following an incident where your Product has been damaged, your Product may be deemed beyond economic repair. This means the estimated cost of repairing the Product exceeds the replacement or market value of Product.
Loss covered by supplier, dealer, or manufacturer’s limited warranty.
Any loss effecting to SIM card and any ancillary products even if Product results into complete stoppage of working.
Damage caused by
(a) A product/accessory that is not the Covered Product
(b) Operating the Covered Product outside the permitted or intended uses described by OPPO.
(c) Service (including upgrades and expansions) performed by anyone who is not an Authorized Service Provider (ASP) of OPPO, or any failure/damage caused outside the Indian Territory.

Covered Product with a serial number that has been altered, defaced, or removed, or has been modified to alter its functionality or capability without the written permission of OPPO.
Cosmetic damage to the Covered Product including but not limited to scratches.
Defects caused by normal wear and tear or otherwise due to normal aging of the product.
Issues that could be resolved by upgrading latest software version.
Third-party products or their effects on or interactions with the Covered Product or the software.
Customer’s use of a computer or operating system that is unrelated to consumer software or connectivity issues with the Covered Product.
Damage to or loss of any software or data residing or recorded on the Covered Product.
Recovery and reinstallation of software programs and user data are not covered under this Plan.
Any loss or damage to accessories and panels even if forming part of the standard pack or to any complimentary or ancillary product/s made available under any promotional scheme.

VI. Cancellation And Refund

For plans bought on e-commerce platform’s, cancellation and refund will follow e- commerce platform’s cancellation and refund policy. For plans bought on other channels, no cancellation is allowed.

VII. Transfer Of Plan

The transfer of Plan from one Product to another Product is not allowed.
In case of change in ownership of Product all benefits under this plan will continue for the remaining plan term.
If the Product is replaced under Manufacturer’s Warranty during the Plan Term, then the replacement Product will be termed as a Product, with the applicable Plan benefits for the remaining period of the Plan Term.
It is the responsibility of the Customer to share the replaced Product IMEI/Serial no. and the replacement invoice issued by the authorised service center.

VIII. Verification of the documents

Before availing the Plan, customer will be required to handover a copy of the invoice to the authorized service center, issued by the OPPO’s ecommerce platform at the time of purchase of the Product and produce the original invoice along with the same for verification.
The Customer must carry and handover a copy of ID Proof (Self attested) to the Authorized service center issued by the government of India. Customer Information on invoice and ID card should match failing, which no claims shall be entertained by the Company.
In case any documents/invoice are prima facie found to be false & fabricated or the original invoice is either lost or torn, customer shall not be eligible for the Plan, the same shall stand forfeited, and no claims shall be entertained in this regard.

IX. Forfeiture clause

Also, if the customer doesn’t avail this Plan within 365 days of the Plan activation, then the same shall stand forfeited and no claims shall be entertained in this regard by the Company later.

X. Conditions related to One Time Screen Protection Plan.

One Time Screen Protection Plan shall be based on parts availability and conditions listed above. Company shall not be responsible for its non-availability due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies, Government decisions, operational & technical issues, or any other force majeure conditions etc.
Plans cannot be exchanged with any other product or item, are non-transferable & cannot be en-cashed under any circumstances.

XI. Publicity

Customers unconditionally and explicitly consent to accessing/use of information and/or images of Customer (if any, clicked or shared by Customer) by OPPO or its authorized agency for media coverage, advertisement, or publicity for present & future communications without any further consideration to the Customer including promotion of its products anywhere in the World.

XII. General Conditions

Customer agrees that OPPO shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Plan or with the acceptance of this Plan.
Customer will get the benefit of the plan only if he/she agrees to repair the complete product (in working conditions). partial repair is not allowed.
OPPO reserves the right to change/alter & modify the terms & conditions of this Plan or extend or annul any part or whole Plan at any given point at its sole discretion without giving any reason whatsoever.
OPPO reserves the right to substitute the One Time Replacement Plan and other Plans with some other gift(s) of equivalent value under this Plan at its sole discretion without giving any reasons.
OPPO shall not be liable for any technical, physical delay in transmission or submission of the entries by the customer or any disruptions, losses, damages, computer related malfunctions/ failures which affect the participation of the customer, or any force majeure conditions or damages caused by Act of God, Governmental actions.
Customers shall comply with these terms and conditions and waives any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless OPPO and its respective affiliates, advertising and promotion agencies, and its respective agents, auditors, representatives, officers, directors, and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from this PLAN.
Benefits of this Plan shall remain limited to the territory of India.
Failure by OPPO to enforce any of its right at any stage does not constitute a waiver of those rights.
In no event shall OPPO be liable for losses or any incidental or consequential damages arising out of or in connection with the Plan, its services these Terms (however arising, including negligence). OPPO shall not be responsible for any product or service liability of any kind.
You agree that any information or data disclosed to OPPO under this Plan is not confidential or proprietary to you. Furthermore, you agree that OPPO may collect and process data on your behalf when it provides service. This may include transferring your data to affiliated companies or service providers in accordance with the Customer Privacy Policy of OPPO, details of which are available on its website under https://www.oppo.com/in/privacy/
In the event of any conflict or inconsistency regarding any instructions, rules, and conditions on any advertising or promotional material relating to the Plan, these Terms shall prevail over all such other instructions, rules and conditions.
Customers acknowledge and agree that they shall not imply or construe any term or condition unless the same is explicitly mentioned by OPPO

XIII. Data Protection

Customers shall always comply with the OPPO’s Privacy Policy made available on OPPO’s website https:/www.oppo.com/in/privacy/
Under the Indian law, the Customer’s rights include:
(a) Customer shall, at any time during the extended warranty, have an option to withdraw his/her consent given earlier to OPPO for collection of personal information. Such withdrawal of the consent shall be sent in writing to OPPO at support.in@oppo.com. In the case any Customer withdraws his/her consent as mentioned herein this Clause, OPPO shall have the option to provide the benefits of the Plan to the Customer.
(b) the right to obtain a copy of the personal data which the OPPO holds about the Customer (the OPPO reserves the right to charge a small fee for the exercise of this right).
(c) the right to have incorrect personal data that the OPPO holds about the Customer corrected.
If any Customer wishes to raise any data protection issue with OPPO, or exercise any of his/her legal rights, please contact OPPO at support.in@oppo.com.
OPPO takes reasonable precautions to keep all Customers personal data secure,and require third party data processors (if any) to do the same. Please note, however, that OPPO may release Customers’ personal data if required to do so by law, or by search warrant or by court order.

XV. Jurisdiction

Decision of the Company in relation to the Plan and matter incidental thereto shall be final and binding on the customer. All disputes shall be governed by the laws of India. These Terms shall be governed by exclusive laws of India and the courts located at Gurugram shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Plan.
