CAMPAIGN TERMS & CONDITIONS

1. Introduction

This OPPO “CHAMPION CAMPAIGN” (“Campaign”) is organised by Boang Technology Proprietary Limited t/a OPPO, a company registered in terms of laws of South Africa with registration number 2020/162436/07 (“OPPO”) together with Telkom SA SOC Limited (“Telkom”)
(OPPO and Telkom collectively refer to as the “Organisers”).

The Organisers are running this EXCLUSIVE incentive Campaign whereby all sales agents, stores and store managers in all Telkom Sales Channel (including direct and express stores) (“Participants”) stand the chance to be the winner(s).

1.1 This Campaign will run from 01 October2022 to 31 January 2023 (the “Campaign Period”).

1.2 The Campaign applies exclusively to Participants who make the highest sales of OPPO Devices (“Qualifying Device”) from Telkom Sales channel during the respective period of assessments (“Participating Channel”).

1.3 The Campaign will be executed within the Participating Channels across 5 (five) regions within South Africa, namely

(a) Gauteng.

(b) Western Cape,

(c) Eastern Cape,

(d) Kwa-Zulu Natal, and

(e) other Regions (being Free State, Limpopo, Mpumalanga, Northern Cape and North West, collectively as one Region); and

(collectively refer to “Regions” and “Region” mean any one of the region)

1.4 By entering the Campaign, all Participants agree to be bound by these terms and conditions as set out in this document (“Rules”).

2. REWARDS (the following Rewards are collectively referred to as “Rewards”)

2.1 During the Campaign Period, the following prizes will be awarded to the Participants who who make the highest sales for the Qualifying Device in all/each Region (as the case may be) during the respective month/s of assessment.

2.2 Floor Salesperson (“FSP”) Rewards

2.2.1 For the month of October 2022:

(a) The top 3 (three) FSP of each Region will each win 1 x R2,000.00 (two thousand Rand) grocery vouchers.

(b) The FSP who sold the most OPPO Reno 8 Pro across all Regions will win 1 x OPPO Reno 8 Pro.

(c) In order to qualify:

(i) for reward as set out in 2.2.1 (a), the FSPs must sell at least 5 (five) Qualifying Devices;

(ii) for reward as set out in 2.2.1 (b), the FSP must sell at least 6 (six) OPPO Reno 8 Pro.

(d) For the purpose of calculating the number of Qualifying Devices sold during the month of October 2022:

(i) FSP will be deemed to have sold 2 (two) Qualifying Devices for each OPPO Reno series device sold; and

(ii) FSP will be deemed to have sold 3 (three) Qualifying Devices for each OPPO Reno 8 Pro device sold.

2.2.2 For the month of November 2022:

(a) The top 3 (three) FSP of each Region will each win 1 x OPPO watch AND 1 x ear buds.

(b) In order to qualify:

(i) for reward as set out in 2.2.2 (a), the FSPs must sell at least 5 (five) Qualifying Devices.

(c) For the purpose of calculating the number of Qualifying Devices sold during the month of November 2022:

(i) FSP will be deemed to have sold 2 (two) Qualifying Devices for each OPPO Reno series device sold; and

(ii) FSP will be deemed to have sold 3 (three) Qualifying Devices for each OPPO Reno 8 Pro device sold.

2.2.3 For the month of December 2022:

(a) The top 3 (three) FSP of each Region will each win:

(i) 1x Mangwanani Boutique SPA voucher to the value of R2,000.00 (two thousand Rand); or

(ii) 1 x SPA voucher to the value of R2,000.00 (two thousand Rand) (two thousand).
At Organizer’s sole discretion.

(b) In order to qualify:

(i) for reward as set out in 2.2.3 (a), the FSPs must sell at least 5 (five) Qualifying Devices.

(c) For the purpose of calculating the number of Qualifying Devices sold during the month of December 2022:

(i) FSP will be deemed to have sold 2 (two) Qualifying Devices for each OPPO Reno series device sold; and

(ii) FSP will be deemed to have sold 3 (three) Qualifying Devices for each OPPO Reno 8 device sold.

2.2.4 For the month of January 2023:

(a) The top 3 (three) FSP of each Region will each win 1 x R2,000.00 (two thousand Rand) cash card.

(b) In order to qualify:

(i) for reward as set out in 2.2.4 (a), the FSPs must sell at least 5 (five) Qualifying Devices

(c) For the purpose of calculating the number of Qualifying Devices sold during the month of January 2023:

(i) FSP will be deemed to have sold 2 (two) Qualifying Devices for each OPPO Reno series device sold; and

(ii) FSP will be deemed to have sold 3 (three) Qualifying Devices for each OPPO Reno 8 Pro device sold.

2.2.5 Overall top FSP during the Campaign Period:

(a) During the Campaign Period, the top 3 (three) FSP who sold the most Qualifying Device in all Regions will each win 1 x Woolworths trolley dashes to the value of R10,000.00 (ten thousand Rand).

(b) In order to qualify:

(i) for reward as set out in 2.2.5 (a), the FSPs must sell at least 5 (five) Qualifying Devices.

(c) For the purpose of calculating the number of Qualifying Devices sold during the Campaign Period:

(i) FSP will be deemed to have sold 2 (two) Qualifying Devices for each OPPO Reno series device sold; and

(ii) FSP will be deemed to have sold 3 (three) Qualifying Devices for each OPPO Reno 8 Pro device sold.

2.3 Store Manager Reward

2.3.1 During the month of October 2022, the store manager whose store sold the most Reno 8 series will win 1 x Reno 8 Pro.

2.3.2 During the Campaign Period, the top 3 (three) Participating Channel store managers whose store sold the most Qualifying Device in ALL Regions will each win 1 x Philip Air Fryer or a Gas Braai to the value of R4,000.00(four thousands Rand), at the winner’s choice.

2.3.3 In order to qualify:

(a) for reward as set out in 2.3.1, the store must sell at least 12 (twelve) OPPO Reno 8 Pro during the months of October 2022.

2.4 Store Achiever Reward

2.4.1 During the Campaign Period, the top 3 (three) Participating Channel stores who sold the most Qualifying Device in ALL Regions will each win 1 x appliance to the value of R5,000.00 (five thousand Rand), at the winner’s choice.

2.4.2 In order to qualify:

(a) for reward as set out in 2.4.1, the store must sell at least 12 (twelve) OPPO Reno8 Pro.

3. GIVING OF REWARDS

3.1 Subject to this Rule, all Rewards will be awarded to the winner on or before 20th (twentieth) of the month following the month of assessing the reward.

4. OTHER TERMS AND CONDITIONS

4.1 Without derogating any other provisions contained in this Rule, the following terms and conditions shall apply to the Campaign.

4.2 Telkom’s Responsibilities

For the duration of the Campaign Period, Telkom shall:

(a) Actively inform the Participating Channels of the Campaign to ensure that the Participating Channels are aware and actively participate in the Campaign.

(b) Daily, provide OPPO with true, correct, and complete sale-in and sale-out list for OPPO to accurately reward the qualifying Participants for the weekly/monthly rewards.

4.3 OPPO’s responsibilities

For the duration of the Campaign Period, OPPO shall:

(a) Ensure that the Rewards are paid out to the respective winners.

4.4 Following persons are precluded from wining the Reward:

(a) Directors, members, partners, promotional and advertising agents, merchandisers, employees, or consultants of Organizers; or

(b) Individuals who are not legal residents and/or legal citizens of the Republic of South Africa; or

(c) Spouses, life partners, parents, children, or siblings of person named in clause 4.4 (a).

4.5 All Participants are required to submit their sales on the Ecentive platform, which is the platform that will used by OPPO to audit and verify the sales. IT IS PARTICIPANTS’ RESPONSIBILITES TO ENSURE THAT HE/SHE SUBMIT THE CORRECT SALES RECORDS ON THE ECENTIVE PLATFORM TIMEOUSLY (on or before 23:59 of the last day of period of assessment of the Reward) , OPPO WILL NOT ACCEPT ANY RESPONSIBILITIES OF WHATSOEVER NATURE IF PARTICIPANTS FAILS TO DO SO.

4.6 No cross-stores sales are allowed under whatsoever circumstances. If a Participant submit his/her sales for different stores, he/she will be immediately disqualified to win any awards.

4.7 If a qualified Participants cannot accept the Reward for any reason whatsoever, the Reward will be awarded to the next selected qualifying Participant.

4.8 The Organizers reserve the right to withhold any Reward until it is satisfied (at Organizer’s sole and absolute discretion) that the claim by the winner is valid.

4.9 Personal information of the qualifying Participants will be used strictly to provide the Rewards and will be stored in a secure system and not transferred to any third party save for the purposes of delivery of the Rewards.

4.10 Participants acknowledge that any personal information supplied to the Organisers for purposes of this Campaign is provided voluntarily, but that they may be prevented from entering or winning a Reward without providing such information.

4.11 This Campaign is advertised by Telkom emailer communications to all Participating Channels.

4.12 The Campaign, the Reward, and any terms and/or conditions surrounding it may be amended by reasonable notification at any time during the Campaign Period and will be applied and interpreted in the sole discretion of the Organizers. Such altered terms and conditions shall become effective immediately after being altered or on such date as may be determined by the Organisers. No Participants shall have any recourse against the Organizers arising from such alterations of the terms and conditions.

4.13 In the event of a tie for the sale of Qualifying Devices for any Reward, the Participants who sold the most OPPO Reno series during the period of measurement will be the winner. To this end, any dispute regarding any aspect of the Campaign and/or this Rule, the Organisers decision will be final, and binding and no correspondence will be entered into.

4.14 The Organisers are not liable for any technical failures affecting Participant’s participation in the Campaign.

4.15 Neither the Organisers, nor any other person or party associated with the Campaign, their associated companies, agents, contractors and sponsors and any of its personnel involved in the Campaign , shall be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Campaign or from claiming the Reward or after claiming the Reward.

4.16 The Organisers reserve the right to extend, reasonably shorten or suspend the time period of the Campaign for technical or commercial or operational reasons or for the greater public good or due to a “force majeure” event or generally for any reason whatsoever within its sole discretion, on condition that it notifies the participants in a manner that is expedient according to its best ability.

4.17 The Organisers reserve the right to amend the rules and/or terminate this Campaign immediately at any stage, whether required as a result of changes in legislation, or if required by any national, provincial or municipal authority, or within the sole discretion of the Organisers for any reason (recognized in law). In such event, all Participants waive any rights that they may have/purport to have in terms of this Campaign and acknowledge that they will have no recourse against the Organisers whatsoever.

4.18 All Participants indemnify the Organisers, its associated and subsidiary companies, and its directors, officers and employees, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever from their participation in any way whatsoever in this Campaign.

4.19 South African law shall govern the Rule.
