The general provisions in Section A apply to you regardless of your location. Section B applies only to customers located in the EU, Liechtenstein, Norway, the United Kingdom or Switzerland ("Europe").

This privacy policy explains how Sinova Europe B.V., together with its subsidiaries (hereinafter referred to as "we", "us" or "OPPO") collects, uses, shares, transfers and protects the user's personal data (hereinafter referred to as "you") and the corresponding rights of the user. Personal data refers to any information relating to a natural person who has been identified or can be identified. [1] In accordance with applicable law, we act as data controller when we process your personal data.
For the purposes of Article 4(7) of the General Data Protection Regulation (GDPR), the data controller is Sinova Europe B.V., a company registered in the Netherlands with its registered office at Kinkerstraat 268-3, 1053 GB Amsterdam, the Netherlands.
- How we collect personal data and what types of personal data we collect
The term personal data is broadly defined and means any information relating to an identified or identifiable natural person. This means that not only data that directly identifies you, such as your name or address, is personal data, but also other data which, when combined with other information available to us, enables us to link that data to you, such as an IP address.
Our channels for collecting personal data include: 1. Personal data that you provide to us directly; 2. Personal data that we automatically obtain when you interact with our Services, such as information about your interactions with our Services or us, and/or; 3. Personal data that we obtain about you from third parties.
The personal data we collect depends on the environment in which you interact with us and the choices you make, including your privacy settings and the features and services you use.
- Personal data provided directly by you
You may provide personal data directly to us, in which case you can generally freely choose which personal data you wish to provide to us. However, if some personal data is necessary for the performance of our Services and you choose not to provide such personal data, we may not be able to provide you with the services you have requested. Personal data that we collect directly from you may include, for example, the following:
- If you order services from us: We may collect your delivery information, bank account number, credit card details, billing address and other financial information related to the transaction, order number, name and contact details, information about purchase/return/refund requests or other requests and other communication information so that we can process your order.
- If you register an OPPO account or join a membership club: Some of our services require you to create an account or complete a personal profile. In these services, we may ask you to provide personal data to create an account or a personal profile. Types of personal data include email address, username and password, region, phone number, profile picture, your membership level and growth value.
- If you participate in a specific OPPO discount program: We may collect your email address and proof of identity to verify your identity and ensure that you are eligible to participate.
- When you follow our social media accounts or otherwise interact with us: We may collect your profile information, the content and details that you post, publish, display, share or otherwise exchange communications or other personal data on publicly accessible areas of our Service. The data we receive depends on your privacy settings on the social network.
- When you share content with others: Some of our services allow you to communicate and share content with others. The communicated or shared content is transferred through and stored in our system.
- We may ask you to provide personal data or collect it under other circumstances, such as in connection with marketing: Such activities include when you participate in sweepstakes, use coupons or participate in other contests, participate in promotional or marketing activities organized by us or our business partners on our behalf, complete surveys or participate in user forums or blogs hosted by us or our business partners. In this context, we may ask you to provide personal data such as name, address, email address, phone number and other personal data as specified in connection with such activities.
- When you subscribe to our newsletters: We may collect your name, email address, phone number and information about how you interact with our advertising communications (e.g. whether you opened the email or clicked on an accompanying link).
- In some jurisdictions, we may be required to perform real-name authentication for certain services you may use: In such case, we will also collect your full name and information about your government-issued ID. If you refuse to provide such personal data, we may not be able to provide you with the corresponding services.
- If we provide you with a chat function or other feature on the website to contact our customer service: We may collect your information including, but not limited to, your account ID, identity verification information, contact information, order information, chat history, complaint or inquiry-related information, information about the product or services being inquired about, etc.
- Personal data that we automatically collect about your use of our Services
In addition to the personal data you provide yourself, we may also automatically collect information about your use of our Services, especially when you use your device. The personal data we may collect includes the following:
- Device information: This may include device name, device model, region and language settings, device identification number (IMEI number), device hardware information and status, IP address, MAC address, operating system version and the settings of the device used to access the Service.
- Log information: This may include when and for how long the Service is used, search terms entered through the Service, and the device's error log. The Android system on your smartphone and/or wearable is designed in such a way that your error or crash log will contain information collected at the time of the incident, enabling us to analyze the causes of the crash. Such information may sometimes include your personal data, such as phone number, email address, Google account or Facebook account. However, we have implemented security measures to ensure that this information is only used for error log analysis and not for personal identification or other purposes.
- Other information about your use of the Service: This may include URLs of the websites you visited before visiting our website (these are called "referring URLs") and your use of supplementary, non-OPPO websites, apps, resources and features used in connection with certain Services; advertising identifiers (including Google Ad ID).

- Personal data we obtain from third parties
We may obtain personal data about you from third parties. For example, where permitted by law, we may obtain data about you from public or commercial sources, including your activity on the social networks you use, and may combine them with other information received from you or relevant to you. In particular, if you interact with us via social media or a third-party service, such as when you like, follow or share OPPO content on Facebook, X (Twitter) or other sites, we may receive information from the social network, including your profile information, picture, user ID associated with your social media account and any other information you allow the social network to share with third parties. We may receive such information.
- Other non-personal data
Non-personal data refers to information that cannot be directly or indirectly linked to a specific person. We may process aggregated or otherwise anonymized data.
We collect non-personal data to understand user preferences, improve our operational efficiency and optimize our websites and your product experience. If non-personal data is combined with personal data, all such data will be treated as personal data.
III. How we use your personal data

- to provide you with OPPO's services, process your orders or fulfill the contract between you and OPPO;
- to help you create and manage your OPPO account, activate services you have purchased, your warranty service and specific software licenses and provide software update notifications;
- to diagnose product problems and provide other customer care and support services;
- to conduct customer surveys to improve your user experience and enhance our Services together with their security features;
- to analyze the customer market based on the country where users use our Services;
- to analyze the effectiveness of our business operations;
- to analyze error logs to improve phone quality and app features;
- to allow and manage your participation in sweepstakes, contests or similar promotional activities that we hold;
- to communicate with you and respond to your questions or comments submitted via email or our online platforms, including social media accounts;
- to ensure the functionality and security of our Services, verify your identity, perform internal audits and prevent and investigate fraud, cybersecurity threats or other improper use;
- to improve and develop our Services to enhance product usage experience, usability, operational performance, features and design;
- to pursue or defend against legal claims;
- to comply with our legal obligations.
- When we wish to use personal data for other purposes not covered by this privacy policy, we will inform you accordingly and ensure that the aforementioned use of your personal data is lawful.
- We do not make decisions involving the use of algorithms or profiling that have legal effects or other effects that significantly affect you.

We use cookies and similar tracking technologies on our website and other Services.
- What are cookies?
Cookies are small text files that are transferred from our Services and stored on your device. Our Services may use "cookies" and other technologies such as pixel tags and web beacons (collectively referred to as "cookies"). Cookies may be stored on your computer. Cookies that are not set by us will not be accessible to us.
- How we use cookies

We cooperate with third parties to display advertisements on our websites and apps or to manage our advertising on other websites. Our third-party partners may use cookies or similar tracking technologies to deliver advertisements to you based on your browsing activities and interests. Please note that opting out of interest-based advertising does not mean that you will no longer see advertising on your device - it simply means that the ads may no longer be tailored to your interests.

- How long we retain your personal data
We only retain your personal data for as long as necessary to fulfill the collection purposes described in this privacy policy, unless a longer retention period is required by law. If we are required by law to retain your personal data beyond this period (e.g. for tax and commercial law reasons), we will delete the personal data at the end of that retention period.
After the expiry of the above-mentioned retention periods, we will delete or anonymize your personal data.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use and disclosure of your personal data, the purposes for which we process the personal data, and applicable legal requirements.
If, after you have subscribed to our promotional emails, you unsubscribe from receiving our promotional emails, we will delete your personal data from our mailing lists. However, we will continue to store your email address in a blocklist to ensure that you do not receive further communications.
- How we disclose your personal data
At times, OPPO may make certain personal data available to other companies that are wholly or jointly controlled by us ("affiliates") and other third parties working with OPPO to provide services to you. Your personal data will not be shared with third parties for their own independent marketing purposes.
- Affiliates: Your personal data may be shared with OPPO's affiliated companies for the purpose of providing our Services to you. If affiliates wish to process data for a different purpose, they must first seek your consent, unless another legal basis exists.
- Service providers and partners: Some of our Services will be provided with the help of third parties. We may also share some personal data with our partners, particularly to provide you with a better service and improve your user experience. For example, we engage third-party providers to provide you with enhanced customer service. We may also rely on service providers to identify and display targeted advertisements, provide email services, provide tax and accounting services, organize contests and provide web hosting or analytics services. All such service providers will, through appropriate data processing agreements, be bound to only process personal data on OPPO's behalf and under our instructions, unless such service providers act as independent data controllers.
- Buyers and third parties in connection with a business transaction: If a merger, acquisition, bankruptcy or similar event occurs, we may transfer or disclose your personal data to a limited but necessary extent to the relevant third party.
- Law enforcement authorities, regulatory authorities and other parties for legal reasons: We may also disclose your personal data to third parties if required by law or if we reasonably believe that such action is necessary (a) to comply with a subpoena or other legal process, legal proceedings or requests from public authorities; (b) when we in good faith believe that disclosure is necessary to comply with the law and reasonable requests from law enforcement authorities; (c) to protect and exercise our legal claims, rights and property; (d) to protect your rights, property or personal safety or that of others; (e) to investigate fraud and (f) to protect the security or integrity of our Services.
- The public when published in certain public spaces: Some of our Services allow you to connect with and interact with others. Your profile information or information that you post in a forum or on a blog, including personal data, will by default be accessible to other users or the public when you create it. Such content will be accessible to the public or members of the Service depending on the Service used.
- Security and protection: If we believe that disclosure is necessary or appropriate to protect OPPO's, our customers' or others' rights, property or safety, to protect the security and integrity of the Services, or in connection with an investigation of suspected or actual fraudulent or illegal activity (this includes exchanging information with other companies and organizations for the purpose of fraud protection and credit risk reduction).
- Public posting: To the public by default when our Services allow you to post information in certain spaces accessible to other users, such as a forum or a blog (such content may be accessible to the public or only to members of the Service depending on the Service used).
- Otherwise with consent: We may disclose your personal data to certain other third parties with your consent.
VII. How your personal data is transferred globally
- We utilize our resources and servers worldwide to provide Services. We have data centers in the United States, France, Singapore, India and Indonesia, which means that in accordance with applicable laws, your personal data may be transferred to or accessed from countries or regions outside the location where you use our Services.
- Please note that different countries or regions offer different levels of data protection. This means that your personal data may be stored in a country that offers a level of protection which, in certain cases, may be less protective of your personal data than the country or region where you are located. In such cases, however, we will take measures to ensure that the personal data we collect is processed in accordance with this privacy policy and applicable laws, and that your personal data is adequately protected. For example, we may ask for your permission to transfer your personal data across borders, and we will implement appropriate security measures (such as encryption and de-identification where possible) and sign the necessary data transfer/sharing agreements with the recipients of your personal data before the transfer takes place. We will also specifically ensure that we comply with laws requiring us to store data locally in a particular country or region.
VIII. How we protect your personal data
- The security of your personal data is very important to us. We have taken reasonable practical, technical and organizational measures in accordance with industry standards to protect personal data collected in connection with our Service and prevent it from accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. Please note, however, that although we have taken reasonable measures to protect your personal data, no websites, Internet transmissions, computer systems or wireless connections are completely secure. In particular:
- Where relevant, we de-identify your personal data to reduce the risk that other organizations or individuals can identify you based on such personal data. We may also implement full security encryption during storage and transmission to prevent unauthorized access, use or disclosure of your personal data (e.g. by using SSL to encrypt many Services). We regularly review practices regarding the collection, storage and processing of personal data (including physical security measures) to prevent unauthorized access to or manipulation of our various systems and your personal data.
- We only allow our employees and personnel from authorized service companies to access such personal data on a need-to-know basis to process such personal data or provide relevant services to you. These employees and external personnel are subject to strict contractual confidentiality obligations. If they fail to meet these obligations, they may be held liable and/or their relationship with OPPO may be terminated.
- When we transfer and store special categories of personal data, we use additional security measures, such as encryption of the transferred content. We also use technical measures to process your personal biometric data so that we only need to store essential data (such as basic parameters necessary to identify a person, but not the raw facial and fingerprint data).
- We carefully select our business partners and service providers and ensure that they are adequately committed to protecting personal data and will be subject to privacy audits and assessments.
- We conduct security and personal data protection training, testing and other activities to enhance employees' awareness and skills in personal data protection.
- We use international and industry-recognized standards to protect your personal data and actively work to obtain relevant security and privacy protection accreditations.
- We promise not to sell personal data to any third party and guarantee only legitimate and fair use of user information to the extent permitted by law.
- In the event of a personal data security incident, we will act in accordance with applicable law and notify you and/or the competent data protection authority of such a security incident where required, and take measures to mitigate any risks arising as a result thereof.
- Your rights regarding your personal data
- Under applicable law in your jurisdiction, you may have specific rights regarding your personal data. This may in particular include the following rights:
- Right to be informed: OPPO publishes this privacy policy to keep you informed about how we handle your personal data and what options and rights you have with respect to your personal data.
- Right of access: If you wish to access your personal data, some of our Services contain an interface where you can directly search for or access certain personal data. You can also request access to the personal data we hold about you and information about its processing by contacting us via the "Contact Us" section.
- Right to rectification: If you find that the personal data we process about you is inaccurate or incomplete, you have the right to ask us to make corrections without undue delay and request supplementation of your personal data where relevant.
- Opting out of marketing communications: If you no longer wish to receive marketing communications, you can unsubscribe from such communications at any time using the method indicated in each promotional message.
- You may also have additional legal rights regarding your personal data, depending on the jurisdiction in which you are located. In this regard, see the GDPR-specific section if you reside in Europe.

- Please note that for security reasons, we may ask you to verify your identity before processing your request.
- Certain jurisdictions may give you the right to refer the complaint to the relevant supervisory authority if you are not satisfied with the response you have received.
- In principle, we do not charge a fee for responding to your reasonable request. However, for multiple and repeated requests exceeding a reasonable limit, we may charge a reasonable fee to cover some of our costs, depending on the nature of the request. We have the right to refuse requests in whole or in part, and we may refuse requests that are manifestly unfounded, unreasonably repetitive, or that require disproportionate technical effort (e.g. requests requiring development of new systems). In addition, we may not respond to requests that directly concern essential matters of public interest or may cause serious harm to your or other persons' or entities' legitimate rights and interests.
- How we process children's personal data
- Our Services are primarily intended for adults. A child should not use our Services without his/her guardian's consent. We treat anyone under the age of 18 (or the equivalent minimum age of full legal capacity in the relevant jurisdiction) as a child.
- If we discover that a child's personal data has been collected, we will delete the corresponding data as quickly as possible.

- Third-party websites
- OPPO Services may contain links to third-party websites, products and services. You can choose whether to access websites or accept products and services provided by third parties or not. For example, the "Follow Us" feature on our official website provides links to our official social media accounts (such as Facebook, Instagram, LinkedIn and X (Twitter)), where you can view marketing or promotional information published by OPPO.
- We do not control third parties' privacy and data protection policies and assume no responsibility for such policies. At the same time, such third parties are not bound by this privacy policy. Therefore, we strongly recommend that before submitting personal data to third parties, you familiarize yourself with these third parties' privacy practices.
- GDPR-Specific Provisions
The following provisions apply only to you if you reside in Europe.
- Legal basis for processing personal data
Our processing of your personal data as described in the section "How we use your personal data" is based on the following legal grounds:
- Consent: We may process your personal data with your consent in accordance with Article 6(1)(a) of the GDPR. In particular, we may ask for your consent to participate in promotional activities, such as sending you promotional messages or enabling you to participate in the user experience program and certain services, including services through which we collect location information. You have the right not to give consent or to withdraw it at any time. The withdrawal of your consent does not affect the lawfulness of our use of your personal data before your withdrawal. If you have given us consent to use your personal data, we will only use it for the purposes specified in the consent declaration. Please note that to the extent our processing is based on your consent and you refuse your consent or withdraw it, we may not be able to provide the service related to it. In addition, neither the original refusal nor a withdrawal will have any negative consequences for you.
- Perform or enter into a contract with you (Article 6(1)(b) of the GDPR):
We particularly rely on this legal basis in the following cases:
- to provide you with OPPO's services, process your orders or fulfill the contract between you and OPPO;
- to help you create and manage an OPPO account, activate services you have purchased, your warranty service and specific software licenses and provide software update notifications;
- to allow and manage your participation in sweepstakes, contests or similar promotional activities held by us; and
- to diagnose product problems, repair customer equipment and provide other customer care and support services.
- Compliance with a legal obligation (Article 6(1)(c) of the GDPR): OPPO may be required to process personal data to comply with our legal obligations, e.g. where OPPO is required to retain data for tax law or commercial purposes.
- Legitimate interests: The processing of your personal data may also be necessary for OPPO's legitimate interests in accordance with Article 6(1)(f) of the GDPR. Such cases may in particular include the following:
- to conduct customer surveys to improve your user experience;
- to analyze the customer market based on the country where you use our Services, including the number of users for product marketing and promotion;
- to analyze the effectiveness of our business operations;
- to analyze error logs to improve phone quality and app features;
- to communicate with you and respond to your questions or comments sent to us in any way;
- to ensure the functionality and security of our Services;
- to verify your identity;
- to perform internal audits and to prevent and investigate fraud, cybersecurity threats or other improper use;
- to improve and develop our Services, including relevant security features, for the purpose of enhancing product usage experience, usability, operational performance, features and design;
- to pursue or defend against legal claims.
Your personal data will only be processed for the above-mentioned reasons after we have assessed and balanced our interests against your right to privacy.
- Further information on how your personal data is transferred globally
If your personal data is transferred to jurisdictions outside Europe, we will ensure that appropriate safeguards exist and are applied, such as:
- the recipient of the personal data is located in a country that benefits from an "adequacy" decision by the European Commission;
- the recipient has signed a contract based on "standard contractual clauses" approved by the European Commission, obliging them to protect your personal data;
- or in the absence of the above-mentioned appropriate safeguards, we will ask for your explicit consent to the cross-border transfer of your personal data or take other measures recognized as providing an adequate level of protection for your personal data.

- Further information on your rights regarding personal data
Subject to the legal requirements under the GDPR, you have the following rights:
- Right of access (Article 15 of the GDPR): You can request access to the personal data we hold about you.
- Right to rectification (Art. 16 GDPR): If you find that the personal data we process about you is inaccurate or incomplete, you have the right to ask us to make corrections without undue delay and to request supplementation of your personal data where relevant.
- Right to erasure (Article 17 of the GDPR): You can submit a request to us to delete personal data, and we have the obligation to delete it without undue delay under certain circumstances - for example if we do not have a legal basis to continue processing the personal data to the extent required under applicable laws and regulations. Please note that to the extent you delete all the data contained in your device, this does not mean that you have deleted all data that OPPO collects and processes about you. Therefore, we encourage you to contact us (please see the "Contact Us" section above) to request that your personal data be deleted.
- Right to restriction of processing (Art. 18 GDPR): You have the right under certain circumstances to request OPPO to temporarily restrict the processing of your personal data, e.g. where the accuracy of such personal data is contested by you, while we verify the accuracy of such personal data. We will only retain enough data or process such data as necessary to ensure that we comply with your restriction request in the future.
- Right to object (Art. 21 GDPR): You have the right at any time to object to any processing justified by legitimate interests based on grounds relating to your particular situation. If you decide to object to the processing of your personal data, we will stop processing your personal data, unless we can demonstrate compelling grounds to continue processing your personal data that override your interests, rights and freedoms, or in the event that we establish, exercise or defend our legal claims. You can object to direct marketing activities at any time regardless of reason.
- Right to data portability (Art. 20 GDPR): You have the right to obtain a copy of your personal data in a structured, commonly used and machine-readable format and transfer such data to another provider or have such data transferred to another provider under certain circumstances.
- Right to withdraw consent (Article 7(3) of the GDPR): If you have given us your consent to process your personal data, but later change your mind, you have the right to withdraw your consent at any time. The withdrawal of your consent does not affect the lawfulness of our use of your personal data before your withdrawal. If you wish to withdraw your consent with respect to receiving advertising communications, you can unsubscribe using the method described in each promotional message. If you withdraw your consent, we may no longer be able to provide the relevant service to you.
- Right to lodge a complaint (Art. 77 GDPR): You have the right to lodge a complaint with a competent supervisory authority about the way we handle or process your personal data, or to bring legal action before a court with jurisdiction. - How this privacy notice is updated
We reserve the right to update or modify this privacy notice from time to time. We will, as appropriate, send you notifications of material updates to this privacy policy in a form we deem appropriate, and we will update the "last updated" date at the beginning of this privacy policy. You are responsible for regularly visiting our website and this privacy policy to check for any changes. Your continued use of the Services after we have made changes is deemed to be acceptance of those changes.
