These Terms and Conditions ("Terms") govern participation in the OPPO Philippines x Mobile Legends: Bang Bang Campaign ("Campaign"). By participating, participants acknowledge and agree to these Terms.
1.1. The Campaign is organized by OPPO Philippines in partnership with Mobile Legends: Bang Bang.
1.2. The purpose of the Campaign is to engage users, promote the OPPO brand, and showcase its products in the gaming community.
1.3. Specific details about tasks, requirements, and timelines will be communicated through OPPO's official channels. Participants to also regularly check updates on OPPO's official channels.
2.1. The Campaign involves user participation in specific activities or tasks related to Mobile Legends: Bang Bang.
2.2. To participate, users must:
• Complete the registration process and provide accurate information, including:
○ Full Name
○ Contact Information (mobile phone number, email address)
○ Delivery Address
○ Facebook Account
○ Mobile Legends: Bang Bang (MLBB) Account
○ Date of Birth
• Follow the instructions and complete the Campaign tasks or requirements communicated by OPPO.
2.3. Participation is free and does not require any purchase.
3.1. OPPO will collect the following personal information for Campaign purposes:
• Full Name
• Contact Information (phone number, email address)
• Delivery Address
• Facebook Account
• MLBB Account
• Date of Birth
3.2. All collected information will be used as outlined in Section 6 (Use of Personal Information).
4.1. This Campaign is open to individuals who:
• Are legal residents of the Philippines.
• Are at least 18 years old. Participants under 18 must have parental or guardian consent.
4.2. Employees of OPPO Philippines, Mobile Legends: Bang Bang, and affiliated partners, as well as their immediate family members, are not eligible to participate.
5.1. Personal information collected will be used for:
• Verifying eligibility and processing participation.
• Communicating Campaign updates and delivering prizes.
• Enhancing future Campaigns and marketing initiatives.
5.2. Participants consent to the use of their information for the purposes above by joining the Campaign.
6.1. OPPO will ensure all collected data is securely stored and handled per its Privacy Policy and applicable data protection laws.
6.2. Personal data will not be shared with third parties without prior consent, except as necessary to execute the Campaign or as required by law.
7.1. OPPO reserves the right to disqualify participants who provide false, incomplete, or fraudulent information.
7.2. The Campaign is subject to changes, delays, or cancellation at OPPO's sole discretion.
Neither party shall be held liable for any failure or delay in performance under this agreement if such failure or delay arises from events beyond their reasonable control, including but not limited to natural disasters (e.g., earthquakes, floods, typhoons), acts of God, wars, acts of terrorism, government restrictions or regulations, pandemics, technical failures, power outages, labor disputes, or other unforeseen circumstances that prevent the fulfillment of contractual obligations.
In the event of a Force Majeure occurrence:
1. The affected party shall promptly notify the other party in writing, providing reasonable details of the event and its expected impact on performance.
2. Both parties agree to work in good faith to mitigate the impact of the event and explore alternative solutions.
3. If the Force Majeure event persists for a period exceeding more than 30 days, either party may terminate the agreement without further liability, except for payment for services rendered up to the date of the event.
This clause does not absolve either party from fulfilling obligations that are not affected by the Force Majeure event.
9.1. Participants must comply with the Campaign's rules and instructions provided by OPPO.
9.2. Any form of cheating, misrepresentation, or rule violation will result in immediate disqualification such as:
• Using unauthorized third-party software or tools to modify the game or automate gameplay.
• Exploiting glitches or bugs in the game or campaign for personal gain.
• Colluding with other participants to manipulate outcomes.
• Using multiple accounts to gain an advantage.
• Providing false or misleading information during registration or participation, such as falsifying your Mobile Legends account information or date of birth.
• Hacking or attempting to hack game servers or systems related to the Campaign.
○ Misrepresentation: This involves providing false or misleading information about a participant's identity, eligibility, or compliance with the rules. Examples include:
○ Providing false information during the registration process, such as using a fake name, contact information, or address.
○ Falsely claiming to have completed campaign tasks or requirements.
○ Misrepresenting their age or eligibility to participate in the campaign.
○ Using a social media account that is not their own to participate in the campaign.
• Rule Violation: This refers to any action that goes against the specific instructions and requirements of the campaign, as communicated by OPPO. Examples include:
○ Failing to complete the campaign tasks within the specified timeframe.
○ Not adhering to the specific requirements or guidelines of a given activity within the campaign.
○ Violating the terms of service or community guidelines of Mobile Legends: Bang Bang.
○ Engaging in any behavior that is considered disruptive, offensive, or unsportsmanlike by OPPO.
○ Any other conduct that violates the stated rules of the campaign.
OPPO reserves the right to disqualify participants for any form of cheating, misrepresentation, or rule violation. The company also has the authority to modify, suspend, or terminate the Campaign and its terms without prior notice. To avoid any confusion, it would be beneficial for OPPO to provide more specific examples of what is considered cheating, misrepresentation or a violation of the rules in future campaigns.
10.1. Eligible participants who complete the Campaign requirements will be considered for selection.
10.2. Winners will be chosen based on predetermined criteria communicated during the Campaign.
10.3. Prizes are non-transferable and cannot be exchanged for cash or other items.
All applicable taxes, fees, and charges imposed on prizes won shall be the sole responsibility of the winner. Winners are required to comply with any and all local, national, or international tax laws related to their prize. The organizing party shall not be held liable for any tax obligations arising from the acceptance, use, or transfer of prizes.
Winners may be required to provide necessary tax documentation or identification to claim their prize, as mandated by relevant tax authorities. Failure to comply with these requirements may result in forfeiture of the prize.
11.1. By participating, users grant OPPO a non-exclusive, royalty-free license to use submitted content for Campaign-related promotions.
11.2. Participants confirm that their submissions are original and do not infringe on third-party rights.
11.3. Participants retain the ownership of their content. However, OPPO will be granted license to use all related content from winners as specified.
12.1. OPPO and its partners will not be held liable for any direct, indirect, or consequential damages arising from participation in the Campaign, except as required by law.
12.2. OPPO is not responsible for technical failures or errors beyond its reasonable control.
13.1. OPPO reserves the right to modify, suspend, or terminate the Campaign and these Terms without prior notice.
13.2. Any updates will be communicated through official OPPO channels.
14.1. By participating, users consent to OPPO using their name, likeness, and content in Campaign-related promotions across online, print, and broadcast media without additional compensation.
14.2. Participants may withdraw publicity consent by contacting OPPO; however, this may affect their eligibility.
15.1. These Terms shall be governed by the laws of the Republic of the Philippines.
15.2. Any disputes arising from the Campaign will be resolved in the exclusive jurisdiction of the courts in the Philippines.
